TERMS AND CONDITIONS OF SALE
(drafted pursuant to Legislative Decree of 21 February 2014, no. 21)
Premise
This contract is entered into between Azienda Agricola Dott. Luigi Rubino – Via Enrico Fermi 50, 72100 Brindisi (hereinafter “Tenute Rubino”) – and the final consumer (hereinafter “Customer”) and qualifies as a distance contract.
It is governed by Legislative Decree of 21 February 2014, no. 21, implementing Directive 2011/83/EU on consumer rights and has as its object the sale of movable goods (wine, food products, merchandising and complimentary items).
With this contract Tenute Rubino transfers or undertakes to transfer ownership of said goods to the Customer and the latter pays or undertakes to pay the price thereof.
The purchase of goods may take place through the website www.tenuterubino.com.
The goods that can be purchased are presented on the website www.tenuterubino.com.
It is specified that Tenute Rubino intends to serve exclusively the final consumer, to whom all products for sale are destined.
Parties with a VAT number who wish to receive an invoice must request it, indicating their details (including PEC and/or SDI code), at the time of the order.
How to order – sales contract

The Customer must fill in the form displayed on the screen which represents their cart, the contents of which may be modified by the Customer at their discretion.
It is possible to correct errors by accessing the cart before the final stage that completes the order.
After selecting the products, the Customer will see the contents of the cart and the related amount to be paid, with the option to update and/or modify it.
Then, the Customer will proceed, by clicking on the appropriate button, to fill in a form with the information required for shipping, invoicing (if requested by the customer), payment and delivery.
Finally, the cart and the related amount to be paid will be shown again.
The sales contract shall be deemed concluded only when the Customer has accepted the terms of sale provided for in the contract by clicking on the “Complete Order” button.
If the Customer does not accept the terms of sale and/or does not proceed to confirm acceptance of the contract by selecting the “Complete Order” button, the sales contract shall not be deemed concluded and the Customer will not be able to receive the order placed.
In this case, Tenute Rubino will not send the products present in the cart nor charge the Customer the amount resulting from the cart summary.
By agreeing to the General Conditions, the User declares that he/she is at least 18 years old and has legal capacity to act.
Description of products, features and prices
The features and description of the products for sale and their prices are indicated via specific links.
Any additional cost, where applicable, is indicated in correspondence with the product to which it applies
Shipping costs
A shipping contribution is required for orders whose value does not exceed 100€.
The shipping cost is calculated automatically by the system based on the number of bottles purchased.
For purchases of an amount equal to or greater than 100€, shipping costs are free.
In both cases, reference is made to orders delivered within Italian territory to the same recipient, regardless of the number of products delivered in a single shipment.
Tenute Rubino reserves the right to adjust the shipping cost if delivery proves to be to one of the remote locations designated as such by the reference shipping company.
Accepted payment methods
The following are accepted: (i) PayPal (ii) cash on delivery (iii) bank transfer.
For cash on delivery payments, a surcharge of 5,00€ applies.
Tenute Rubino will not charge Customers, in relation to the above payment methods, any fees for their use, or, in the cases expressly provided, fees exceeding those incurred by Tenute Rubino itself.
PayPal
You can choose to pay using this method by selecting the PayPal option; once you reach the third step of the purchase process (“Confirmation”) click on “Confirm and proceed with PayPal” to complete your order.
If you already have a PayPal account, log in with your e-mail and password and confirm the payment.
If you do not have a PayPal account, you can create a new one using your credit/prepaid card; in this case you just need to select the card type, fill in the required details and confirm the payment.
The order is processed as soon as the payment has been credited.
If you return the goods, the amount of your order will be refunded to your PayPal account (or to your credit card if you are an unregistered PayPal user).
Credit card
For payments by credit card we use PAYPAL PRO, so you can pay easily and in complete security.​
We accept Mastercard, Visa, Visa Electron, Postepay, American Express and all major credit and debit cards in circulation.
PayPal complies with the international PCI-DSS (Payment Card Industry Data Security Standards).
This is an international security standard that applies to all companies that acquire, store, process or transmit information relating to payment card holders.

Delivery terms and liability
In compliance with art. 61, Legislative Decree 21/2014, Tenute Rubino undertakes to process the ordered goods within 48 (forty-eight) hours for orders completed with electronic payment (PayPal) or cash on delivery.
For orders paid by bank transfer, an approval phase by the company is envisaged which confirms that the funds have been received, and therefore the 48-hour processing time cannot be guaranteed.
In both cases, Saturdays and Sundays and/or other public holidays are not included in the calculation of the 48 hours (for example, an order placed on Friday or on the day before a public holiday will be processed on the first subsequent working day).
Delivery is deemed completed when the ordered goods come into the possession of the Customer or the person authorised by the Customer to collect them.
If these time limits cannot be met (e.g. products not in stock), Tenute Rubino undertakes to notify the Customer using the quickest possible method to inform them and indicate when the goods can be delivered.
Unsolicited supplies
Without the Customer’s consent, to be expressed before or at the time of conclusion of the contract, Tenute Rubino will not make any supply other than that agreed, even if of equivalent or superior value and quality.
If the Customer receives a supply that does not comply with the order placed, they must notify Tenute Rubino at shop@tenuterubino.it, so that Tenute Rubino can arrange collection of said supply and replace the goods with those requested.
RETURNS AND REFUNDS
Returns are only possible if the goods are intact, within 15 days of receipt.
The bottle must be closed and sealed, the front and back labels undamaged, the glass must not be damaged, and the cardboard packaging intact.
To request a return of the goods, the Customer must write to shop@tenuterubino.it.
Once the request has been received, Tenute Rubino will send the Customer written confirmation.
At this point the Customer must send the goods via express courier or Poste Italiane to Tenute Rubino, Via Enrico Fermi 50, 72100 – Brindisi.
The package travels at the Customer’s risk.
The goods must be returned including everything that forms part of them (cartons, labels, bottle, corks, etc.).
The cartons and bottles leaving our company are obviously intact.
If the parcel appears damaged, the Customer must not accept it but return it to the courier.​
Tenute Rubino will then contact the company in charge of delivery and arrange a new shipment.
The Customer will not be penalised in any way and will receive their order a second time, without adding anything to what has already been paid when confirming the order.
To report damage to the parcel at the time of receipt, write to shop@tenuterubino.it.
In case of damage, it will be necessary to attach a photo of the broken bottle(s).
If the Customer requests a refund from Tenute Rubino, this will be made by crediting their PayPal account (if the Customer paid via PayPal) or by bank transfer (if the Customer paid by bank transfer or cash on delivery).
The credit may be visible on the Customer’s bank account approximately 30 days after the refund date.
Jurisdiction
For any civil dispute between Tenute Rubino and the Customer arising from the interpretation of the regulations and the conditions set out herein, the mandatory territorial jurisdiction shall lie with the Court of the place of residence or domicile of the Customer, if located within the State.
